Private Legal Fees (Family and Probate)

Our fees are charged on an hourly basis, meaning that we only charge you for the actual time spent on the case. Our rates are as follows:

Senior Lawyer/Solicitor/Director £245.00 plus VAT
Associate Solicitor or Equivalent £210.00 plus VAT
Assistant Solicitor/Legal Executive (FCILEX or GCILEX) £161.00 plus VAT
Legal Administration Assistant £120.00 plus VAT

All hourly rates are exclusive of VAT and disbursements.

 

Probate Pricing

Here at MD Law, we understand that dealing with probate can be an emotional as well as difficult time for our clients. We can help you every step of the way, from obtaining the Grant of Probate and collecting assets to distributing to beneficiaries.

We always like to meet with our clients at the outset so that we can give a more accurate idea of the costs involved with each particular case. Legal fees up to the issuing of a Grant of Probate usually start at around £3,000.00 plus VAT and additional fees for disbursements, but these fees can vary drastically, depending on the individual circumstances, so we always have to ensure that we discuss in detail with you your circumstances.

Once the Grant of Probate has been administered we will then work with you to distribute the Estate. In most cases this costs approximately £2,000.00 plus VAT but this is something that we shall need to review and keep you informed as to progress.

The average timescale for probate is between 6 -10 months, although this can vary considerably depending on the Estate size and whether information is provided to us promptly.

Once Probate has been granted at the Probate Registry (unfortunately we cannot give a definite timescale for this at the moment). However, once Grant of Probate is received, it can take us 6 to 10 weeks to distribute the Estate. These services are carried out by our friendly and experienced solicitors and include:

  • Locating the legally appointed administrators, executors, and beneficiaries.
  • Providing legal advice on the appropriate applications that will need to be made.
  • Gathering the appropriate documentation and preparing the application.
  • Lodging the application at the Probate Registry on your behalf.
  • Obtaining the Grant of Probate and ensuring you have sufficient copies.
  • Collecting all of the assets in the Estate and distributing in a timely manner.


Disbursements

Probate fee - £215.00 plus £1.50 per copy (if Estate value is less than £5,000, this is free of charge)
Bankruptcy Searches - £2 per beneficiary
Public Notices (newspaper advertisement) – Between £300 and £700 plus VAT (again these fees vary dependant on the type of article you require to be placed into the London Gazette and local paper, which we will usually advise you to do).
Swearing of Oath – Between £5 - £15


Potential Additional Costs

  • Dealing with a sale or transfer of property. Please see our pricing below for our legal fees for conveyancing. It is usual for us to charge an additional legal fee of £75.00 plus VAT if we are selling a property as part of a probate matter.
  • Income and Capital Gains Tax. As we are not tax specialists or qualified to offer specific tax advice, it is likely that you will need assistance from a tax specialist to work out any tax that is payable and or if a rebate is due to the Estate. If you need to instruct an accountant/tax advisor to assist their charges will be independent of our charges. 
  • Inheritance Tax. Dependant upon the size of the Estate there may be Inheritance Tax due which we are only able to assess after reviewing the size of the assets within the Estate. 
  • Tracing Services. We may have to instruct a third party, such as a tracing agent, but we will always discuss their costs and liaise with you to inform you of any prices to be paid if this service is required, for example, tracing unknown beneficiaries.
  • Trusts. There will be additional fees if we are asked to set up and administer a Trust.
  • If the Estate is insolvent.
  • Preparation of Deeds of Variation.
  • Dealing with contentious probate.


Conveyancing Pricing

At MD Law, we like to keep our pricing fair and transparent for all of our clients so we charge the following for a sale or purchase and charge additional fees if applicable - see below for more information.

  • If property value is less than £550,000, our fees will be £625 plus VAT
  • If property value is between £550,001 and £1,000,000, our fees will be £750 plus VAT
  • If property value is more than £1,000,001, our fees will be £1,200 plus VAT


Purchases

Our legal fee for a purchase transaction is as above
Plus the fee for acting for a mortgage lender of £180.00 plus VAT
Plus a CHAPS administration fee of £35 plus VAT 
Plus an Anti-Money Laundering ID Check administration fee of £15 plus VAT
Plus (Optional) E-Signing Service of £15 plus VAT

Disbursements that would be applicable for a purchase transaction are:
Combined Search Pack - Local Search/Environmental/Drainage and Info Track Property/File Plan - £123.10 (which includes VAT of £20.52)
Coal Search - £57.60 including VAT (if applicable)
Land Registry searches - £3
Bankruptcy Searches - £2 per purchaser
CHAPS Bank charge - £15

Land Registry Fee – this fee is variable dependant on the purchase price. Please go to https://www.gov.uk/guidance/hm-land-registry-registration-services-fees, which details the Land Registry fees based on a Scale 1 fee as listed therein.
Stamp Duty Land Tax (SDLT) or Land Transaction Tax (LTT) – variable depending on your circumstances. Please refer for properties in Wales to https://lttcalculator.wra.gov.wales/ or for properties in England https://www.gov.uk/stamp-duty-land-tax

Sales

Our legal fee for a sale transaction is £625 plus VAT
Plus an administration fee for discharging a mortgage of £100.00 plus VAT
Plus a CHAPS administration fee of £35 plus VAT
Plus an Anti-Money Laundering ID Check administration fee of £15 plus VAT
Plus (Optional) E-Signing Service of £15 plus VAT

Disbursements that would be applicable for a sale transaction are:
Official Copies of the Register – usually £6 to £12
CHAPS Bank charge - £15

Remortgage

Typical fees for a straightforward remortgage - £400 plus VAT of £80
CHAPS Administration Fee - £35 plus VAT
Anti-Money Laundering ID Check administration fee of £15 plus VAT
Office copies and file plan - £6
Pre-completion searches OS1 - £3 per lender and bankruptcy searches £2 per person
Copy Lease (if Leasehold) £6
CHAPS Bank charge - £15

Total for one individual remortgaging a Freehold property £548.00

However, there will be an additional disbursement fee for registering the remortgage with the Land Registry as explained below. Please add this to your total for example:

A remortgage property with a mortgage advance of £100,000 will attract an additional fee of £20.00 via an online application or £40.00 if the application has to be dealt with via the post.

Transfer of Equity

Our legal fee for a transfer of equity transaction is £450.00 plus VAT
If the mortgage lender is involved then add an Acting for Lender Fee of £180.00 plus VAT
If the Transfer is for consideration then add a CHAPS Admin Fee of £30.00 plus VAT

Disbursements that would apply are:
Land Registry Priority Search £3.00
Land Charges Search £4.00
No Search Indemnity Policy (Depending on Lender) £18.00
Environmental Search (Depending on Lender) £42.00
Land Registry Registration Fee £30.00


Employment

Employment Tribunal: For providing representation and advice to an individual or business in order to bring a claim before the Employment Tribunal against their employer or employee for unfair or wrongful dismissal.

Our fees would range between £600 to £15,000 plus VAT for a non-complex matter and up to £65,000 plus VAT for a complex matter. Our fees would really depend on volume of documents, number of witnesses, how complex the matter is, how far you wish to take the matter through the Employment Tribunal procedure and the amount of damages in dispute.
